The Integrated Credit Solutions/Flagship Capital Services/Lighthouse Credit
Foundation has finally been
slapped by the FTC
and made to repay $2.4 million in consumer redress.
The scam has collapsed! OneSetPrice and its related scam enterprises (most
notably, Internet Marketing Group and RPM Marketing Group) have
forfeited their remaining
assets; and in addition, gang members Cindy Austen Gannon and
Michael J. Hatch have to fork up an additional $99,500 and $97.875.78
respectively. Gannon and Hatch, along with fellow crooks David G. Cutler,
Paul D. Bonnallie, and Tisa Christiana Spraul each have a $15 million
judgement hanging over their heads, suspended based on their ability to pay.

shut down
by the Federal Trade Commission. Read what the court-appointed receiver

It seems that quite a few people were defrauded by these crooks. Not only
that, but it looks like the principals in the scam violated the restraining
order and tried to empty their bank accounts after they got served. It's too
bad that their shyster "house counsel" Gerald K. Burton wasn't also whacked;
he liked to write threatening letters and file harassment lawsuits. Burton
should be taught how to care in Florida's electric chair.
Older News
The 10th US Circuit Court of Appeals has upheld the National Do No Call
Registry, dismissing telesleaze claims that it "violates free speech
rights." The telesleaze are now whimpering that about 2 million jobs
in their disreputable industry will be lost within too years. None of
us need to shed any tears.
The sleazebags in the credit counseling industry are placing calls to numbers
on the National Do Not Call Registry. It is no surprise that a disreputable
industry would disregard the law and a explicitly registered desire not to be
contacted.

According to the
Denver Business Journal,
OneSetPrice paid $25,000 to a lawsuit filed by the Attorney General of
Colorado
for calling Colorado residents on its no-call registry
after receiving "cease-and-desist" orders. Read the text of the complaint
here. As part of the settlement, a permanent injunction
was issued against OneSetPrice. OneSetPrice defaulted on this agreement and
one with the state of Florida.
Massachusetts
has sued Integrated Credit Solutions in federal court seeking recovery of
$1 million paid by Massachusetts residents. More details

Introduction
This site is a work in progress, and will be updated as new details emerge.
Automated telemarketers use automatic devices to play a prerecorded
message to private telephones. These calls are illegal under federal
law and the laws of many states including Washington State where this
site is located. Unfortunately, our politicians and law enforcement
agencies have little interest in enforcing the law, and instead expect
the victims to go to court for a puny $500 in damages.

This site lists the despicable human vermin who have spewed their
solicitations at my home phone, in spite of the fact that my home
phone has No Solicitation service which explicitly instructs all
telemarketers to hang up and add my number to their no-call list.
Things to Keep in Mind
-
Telemarketers are amoral thieves. They believe that it is alright
to invade a private home in order to steal the resident's time.
-
Telemarketers are liars. Either the product is a scam, or they are
selling the product at an inflated price or to someone who doesn't need it.
-
Telemarketers use threats and intimidation.
-
Telemarketers do not have "free speech" rights to call unwilling
recipients.. The US Supreme Court ruled many years ago, in an option
written by Chief Justice Berger: "Nothing in the Constitution compels us to
listen to or view any unwanted communication, whatever its merit. We
categorically reject the argument that a vendor has a right under the
Constitution or otherwise to send unwanted material into the home of another.
If this prohibition operates to impede the flow of even valid ideas, the
answer is that no one has a right to press even `good' ideas on an unwilling
recipient. [The] right...stops at the outer boundary of every person's
domain."

You are under no obligation to be polite to telemarketers.
-
Telemarketing operators are by nature fly-by-night operations.
Bankruptcy is their inevitable fate.
-
Telemarketing is not a reputable business tool; nor, for that
matter, is any other method that annoys customers or potential customers.

Telemarketing using automatic dialers is particularly disreputable; it
indicates that the company thinks so little of its customers that it is
not even willing to expend the effort of a human to place the call.
The most egregious example of this is the practice of using predictive
dialers, in which the telemarketer mass-dials a large number of phone
numbers and hangs up on anyone who answers if a human telemarketer isn't
available at that instant in time to deliver the sales pitch.
Automated telemarketing, in which even the sales pitch is automated, is
done only by disreputable companies which have utter contempt for the
people that they call and are willing to break the law.

When you pay extra money for No Solicitation service from the
phone company each monthy, you have a legitimate expectation of
privacy on your home telephone. There is no "First Amendment
right" to disregard a person's stated desire not to be solicited.

Sleazy companies often hire sleazy lawyers. The fact that a sleazy
lawyer says something does not make it true. Watch this section in the
future for postings of highly amusing correspondence from the sleazy lawyers!!
What to Do

Use existing state and federal laws to sue automated telemarketers.
-
Write to your Senators, Congressmen, and state government officials to
demand that sterner laws be passed to suppress telemarkers.

Publicly "out" all illegal automated telemarketers.

File a federal complaint about illegal telemarketers with the

Commission.

Foundation. You may recall correspondence stating that you have been
approved to consolidate your credit cards down to as low as 1.5 percent
interest. I'm surprised you haven't called, because this is not a new
loan, and again you have already been approved by a nonprofit agency.
In order to lower your rates before your next billing cycle, I do need
to find out what your balances are presently, so if you could please have
your statements available when you call, that would be great. I'll be in
the office till 10 p.m. Eastern time. My number toll-free is
(800) 774-1130. Again it's 1 (800) 774-1130. Thank you.

Response to demand letter: both William K. Budd, ICS's "vice president &
general counsel", and Nancy Higgins, ICS's "compliance specialist",
claim that they are allowed to do this because "ICS markets on behalf of
tax-exempt non-profit organizations" and claim that this makes ICS exempt
from the federal TCPA. More on these so-called "tax-exempt non-profit
organizations" below. U.S. District Court Judge Joseph L. Tauro has
rejected this claim. So has the
New York Supreme Court.

They also claimed that they would not call me again. So, how did they
explain those
harassment calls
in October, November, and February with their number in the
Caller ID? What is this lame explanation to the police that they
"may have a person hacking into their system"?

The more stringent
Washington State law has no loophole for non-profits, and is
taking action against ICS in spite of their defiance.
Note ICS's false claim that the federal TCPA preempts more state law. The
TCPA says otherwise; read 47 USC 227(e)(1).

Neither the FTC nor other states were
impressed either; ICS and Lighthouse have been fined or
sued by
the Federal Trade
Comission (which whacked them for $2.4 million!),
California (which
whacked them for $1.89 million!),

has issued them an immediate cease and desist, as also reported in
AARP ElderWatch.

Integrated Credit Solutions has an
unsatisfactory rating
for "misleading selling practices, unsatisfactory performance, and consumer
requests for refunds." Consumers who sign up with
Lighthouse Credit Foundation's debt management program have complained about a
lengthy time frame
in their service; supposedly this has been "addressed and eliminated."

The Better Business Bureau serving
Eastern Washington & North Idaho
is a lot less sanguine about Lighthouse Credit Foundation based on a call
made to a woman in Yakima.

Other names associated with ICS are Flagship Mortgage Services, Flagship
Capital Services and Lighthouse Credit Foundation. Here's what I've been
able to untangle of this web so far (more is coming!):

According to the
St. Petersburg Times,
ICS chief executive Steven McWhorter previously ran Flagship Mortgage
Services, the home equity unit of Republic Bank of St. Petersburg shut down
in late 1998. Flagship Mortgage Services marketed home equity loans
nationwide as a way for high-risk borrowers to escape credit card debt.
When investors stopping buying the loans, Republic restructured its mortgage
business to focus on selling first mortgages from its branches, laying off 340
employees and taking $7.5 million in charges.

Flagship Capital Services (formerly known as "Twenty-First Century Lending
Corporation") was (also?) in the residential mortgage business; and apparently
in its subprime aspect. Flagship Capital Services says that it ceased these
lending activities in approximately July 2000, and now functions solely as
a holding company for ICS. Twenty-First Century Lending Corporation filed
as a foreign profit corporation on January 1, 1999, and filed its name change
to Flagship Capital Services on May 26, 1999.

Integrated Credit Solutions (formerly known as "Flagship Capital
Arbitrations Services Corp.") is a wholly-owned subsidiary of Flagship
Capital Services, and "engaged in the business of marketing and providing
call center support for tax-exempt organizations such as Lighthouse Credit
Foundation." Since September 2000, ICS "offers for sale consumer credit
counseling and debt-management programs developed, managed, operated, and
under the exclusive control of Lighthouse Credit Foundation", and define
"offer for sale" as "enrolling customers to participate in Lighthouse
programs" at an "average enrollment fee of $240." Flagship Capital
Arbitrations Services Corp. filed as a domestic profit corporation on
April 28, 2000, and filed its name change to Integrated Credit Solutions
on June 28, 2000.

Lighthouse Credit Foundation, Inc. (formerly known as "Capital Credit
Foundation, Inc.")
is the "tax-exempt non-profit organization" in whose "behalf" ICS
makes the calls. Capital Credit Foundation filed as a nonprofit corporation
on July 14, 2000, and filed its name change to Lighthouse Credit Foundation
on November 27, 2000.

Lighthouse's head honcho is Mary Melcer, a former
Republic Bank colleague (senior VP of mortgage banking) of McWhorter and
Mickey Malone (Flagship/ICS VP) who is described by the
Massachusetts Attorney General in its lawsuit against ICS as having "no
previous experience" with credit counseling or managing non-profit
organizations.

ICS claims not to be affiliated with Lighthouse except by
a contractual basis. Let's examine that statement.
-
According to the
Massachusetts Attorney General (also read
here),
Lighthouse Credit Foundation was established by Mary Melcer, a former senior
vice president of Flagship who "was, and remains one of the investors in the
re-capitalized Flagship...owned, and continues to own, approximately four
percent (4%) equitiy."
Coincidence?

Again according to the Massachusetts Attorney General, in early summer 2000
Melcer "discussed with other Flagship managers" her "establishing
a non-profit to service new clients solicited by ICS" and shortly thereafter
"left her employment at Flagship and established Lighthouse. Coincidence?
-
Again according to the Massachusetts Attorney General, ICS paid Lighthouse
$65,000 in an undocumented transaction to help Lighthouse get started.
Initially Lighthouse shared ICS' office space rent-free, and shared the
same telephone system. Coincidence?

There is a very narrow timeline of events:

late 98 Republic Bank of St. Petersburg shuts down Flagship Mortgage Services
after huge losses.

01/01/99 Twenty-First Century Lending Corporation files as a foreign profit.

05/26/99 Twenty-First Century Lending Corporation changes its name to
Flagship Capital Services.

04/28/00 Flagship Capital Arbitration Services files as a domestic profit,
owned by Flagship Capital Services.

06/28/00 Flagship Capital Arbitration Services changes its name to Integrated
Credit Solutions.

Lighthouse Credit Foundation is at the same address, albeit a
different "suite", as Integrated Credit Solutions and Flagship Capital
Services. In the original
Articles of
Incorporation for Capital Credit Foundation, no mention is made of any
"suites" in the address. The first occurance of "suite" in Lighthouse's
filings appears when they changed their name. Lighthouse has moved about
in that building a lot: first it was 210, then it was 150, now 125.
Coincidence?

The registered agent that created ICS and Lighthouse is the same:
Corporate Creations Enterprises at 941 Fourth St. #200, Miami Beach,
FL 33139. Coincidence?
-
The original names of ICS (Flagship
Capital Arbitrations Services. Corp.) and Lighthouse (Capital Credit
Foundation) implied a relationship with Flagship Capital Services. The
new names do not. Coincidence?
-
ICS says that its business is for "tax-exempt organizations such as Lighthouse
Credit Foundation" (which implies other organizations besides Lighthouse).
However, their answer to a subpoena from the Vermont Attorney General for
"every [my emphasis] product and service" only discloses the work
with Lighthouse.
-
Yet we're supposed to believe in spite of all of these coicidences that
ICS and Lighthouse have no relationship with each other other than a
"contractual" one.
-
The Florida Attorney General's Economic Crimes Division
civil investigation
seems to lump them together as a single entity under investigation.
-
One thing to remember about "debt consolidation" companies is that they are
bottom-feeders...and you are their food! Some are quite a bit more
reputable than others. However, keep in mind that these companies are making
money from you (the sign-up fee and cuts out of the payments you make to them
to pay your creditions); money that could be put into reducing your
debt. You are likely to get an adverse rating on your credit report just for
dealing with them; and if they make a late payment, or miss a payment, to one
of your creditors, you will get an adverse rating on your credit report.

The mere fact that you talk to these people is enough to get your creditors
to close your account and place a note on your credit report that you are
using a debt management service (and thus are a bad credit risk).

Here is
what the Massachusetts state senate has to say about the credit counseling
industry: "Abuses have been widespread in this industry", "more than
three-quarters...are operating illegally", "these firms are essentially
unregulated", "seriously harming consumers by charging high initial costs,
failing to make payments to creditors as promised, tarnishing credit records,
and engaging in questionable business practices."

a fine organization that assists the vision impaired.
Lighthouse International had to put up a

Response when called: I spoke to a very obnoxious man who claimed that they
left their recording on my voice mail system instead of calling. That is
false; I picked up the call. Apparently their fancy equipment can't tell
the difference between the No Solicitation announcement and voice mail. He
kept on yammering that I should speak with their lawyer.

Response to demand letter: Gerald K. Burton, OneSetPrice's "house counsel",
made a thuggish threat to sue me if I had the temerity to take action
against OneSetPrice in Washington State court, and that "under no
circumstances" would they ever pay civil damages. Burton also claimed
that the purpose of the call was to "invite" me to "a free seminar."

Burton has sent
other
such letters. Apparently, intimidation is his job function.

Burton's latest ploy is to claim that federal law trumps Washington State
law. Integrated Credit Solutions has tried the same thing.
-
Besides being unethical (duh), Burton is an admitted liar. For some
time, he insisted that it is "impossible" that their automated call
could have reached me personally, and that instead it was delivered to
my "answering machine." I don't have an answering machine! It was
only after he was forcibly confronted with facts that he admitted that
he was not lying; in a three-page diatribe to the Better Business Bureau
dated September 25 he confessed that "on occasion [their equipment] does
not disconnect immediately."

Burton also lies when he says that OneSetPrice will never settle. I have
two confirmed instances of them settling.
-
Burton also says that he "does not know where [I] am coming from...a very
few people, a very small fraction of 1%, object to the manner in
which OSP does business." Is it really true that more than 99 out of 100
people approve of receiving automated telemarketing calls?
-
Burton apparently does not like this bad publicity. He has said that he is
going to threaten my ISP to get them to take this page down or disconnect
the entire panda.com site. It evidentally has not dawned on him that none
of this would have happened if, instead of sending me threatening letters,
his company had just paid the civil damages that they legally owe me.

Here
is what the court-appointed receiver has to say about what they discovered
about OneSetPrice and its associated companies. It is grim reading. A lot
of people were hurt by these crooks.

has OneSetPrice on their list of

Information gleaned from the Better Business Bureau web site and OneSetPrice's
own web site: It's a franchise offering. The "free seminar" is a hard-sell
that offers a "business opportunity" (entry cost between $16,470 and $51,470)
to sell long distance telephone cards (at 5-10 cents/minute) using VoIP.
Supposedly, you'll make lots of money selling these overpriced cards.

OneSetPrice was a member of the Orlando Better Business bureau, but that
membership was revoked on August 28, 2003, and OneSetPrice has an
unsatisfactory rating
"due to unanswered complaints".

Colorado
has issued them an immediate cease and desist for no-call violations.
That apparently was not enough, since Colorado
sued
OneSetPrice for continuing to call and obtained $25,000
in settlement as well as a permanent injuction. Read the text

What's really funny is that the
Rocky Mountain News
reports that Burton claimed that the calls were "totally unintentional" and
blamed "incompetant employees." OneSetPrice defaulted on this agreement and

A Seattle lawyer took OneSetPrice to court and sought treble damages under
42 USC 227(b)(3) and RCW 19.86.090. OneSetPrice first offered to settle for
$400 with a confidentiality and non-competition clause. They finally settled
for $900 with no such clauses.

OneSetPrice has settled with other individuals. Their standard procedure
seems to be to ask the court to allow them to attend by telephone, and only
after that is turned down do they settle.

I have an unconfirmed report that some people in New Mexico are considering
legal action against OneSetPrice after signing up and having less than
positive experiences.

The Orlando Better Business Bureau reports that Paul Bonnallie and David
Cutler from OneSetPrice spawned a new business,
Platinum Plus Savings.
They apparently jumped back to OneSetPrice, and Tom Dahl (erstwhile
OneSetPrice National Training Director) is now the CEO of Platinum Plus.
Platinum Plus telemarkets to suckers who pay up to $39,995 for the right
to sell $49.95 "merchant discount" cards, and also has an unsatisfactory
record with the Better Business Bureau.

A class-action suit against OneSetPrice has been filed in California.

Response when called: I located their primary voice number in the phone
directory. The receptionist admitted that the calling number was one
of theirs and that they use automated telemarketing devices. I therefore
gave her, for transmission to her masters, an oral offer to settle if
they would pay me $300 without necessitating me to take them to court.
I repeated that offer in the demand letter mailed the same day.

by the state of Oregon for similar activities.
